Terms and Conditions

This site is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law, subject to the terms of Public International Law.

The Parties consent to the jurisdiction of the Magistrate’s Court of South Africa for any proceedings arising out of or in connection with this Contract.

Any dispute, controversy or claim between the parties arising out of the contract or breach, termination or invalidity thereof, unless settled amicably between the parties, shall be referred to the Arbitration Foundation of South Africa (AFSA) for arbitration in accordance with the Rules of the Arbitration Foundation of South-Africa.

Both parties expressly acknowledge and agree that they shall first seek an amicable resolution through the aforementioned arbitration process before initiating any legal proceedings in a court of law. It is further understood and agreed that arbitration is a prerequisite and must be exhausted before either party can initiate litigation.

The complainant party shall bear all expenses associated with the arbitration process, including their own travel and accommodation expenses.
